Investment property rights with ex partner who is trying to force me to sell?

I own a rental property with my x boyfriend, we bought the property in 2007 december and lived in it for two years, and lived in a rental property for 1.5 years before that, when we broke up we stayed friends and rented the property out (It was only rented on a 12 month lease in Sept 2010). I was just going through the process of refinancing our joint debt to our mortgage so that all we will have left is the mortgage and splitting the rental income. I was refinancing at 6.75% for three years. The valuation just came back from the loan application and he went behind my back and found out what the property is worth and now he wont go ahead with the loan and is trying to force me to sell when it comes out of its current fixed rate in dec 2010. The property only costs us per week each after the rental income comes in and its in an area that is growing and growing to the point where in three years it will be worth a lot more. I dont want to sell at all, and now he is trying to force me to sell because he wants to get a property on his own. We both pay the same on the current mortagage and we have no other assets together. I dont earn enough to sell and get a mortgage on my own like he does so its not smart for me to sell. Any advice on what I can do? Can I stop him from selling or drag it out in court for a few years so it gains more value? What are my rights? We were in a de facto relationship. Please please help me!! Im so stressed. I cant buy him out as i cant be approved for a loan of that amount. I might be able to get my sister to go on the loan with me but she is on a disability pension with no debts and can service the loan, but im not sure if you can do it on disability pension.


Home equity loans used as investment?

We are little naive about finance…duh…we have about 300k in
equity in our home and wondered when you release that equity to say buy a holiday/investment property…are you essentially upping your mortgage by that amount?so you actually are paying double maybe triple the repayments….pls explain


Investment property? Looking for advice from fellow Australians.?

Do you think it’s better to buy units or houses? Units seem to be more appealing because the gap between rental income and the mortgage is smaller, but the appreciation would be less? Am interested in hearing your opinions as we’ve saving a decent deposit and are wondering where to go from here. We currently live overseas so can’t buy something to live in at this stage.


Hi, I need advise regarding First home & Investment Property?

Hi, We bought our First Home in Perth in Feb 2008. It is 3 Bed Room house. Last month we bought an investment property, it is 5 bdr, 2 bathroom. Settlement date is 27th Feb 09. My sons saying we should live in big 5 bdr property and 3 bdr should rent out.
My question is: Can I do it? Do I need to ask lender (ANZ Bank)? Or just move in 5 Bdr property and 3 bdr leave on rent and pay mortgage.
(I know that it will be less return for 3 bdr )

would i gain by selling my investment property?

i have an investment property which i owe k on. i bought it for 5k and could sell it for 0k conservatively. if i sell it after i pay the k and the capital gains i would have say 0k which i could use to pay off some of my 0k mortgage on the house i live in and own with my partner. if i do this i would save approx 0k in interest over the next 30years (i think). but then i wouldn’t have an investment property which would be earning me money forever.

so would i be better off to sell the property and save a lot of money in interest which would allow me to do other things such as have a baby? or should i keep the investment property for its never ending income.

the property makes approx k per year after expenses.

Turn own property into investment property?

I currently have a mortgage and am looking to move interstate and want to turn my current property into an investment property. My main question is
a) should I sell and buy interstate or
b) make it an investment property and rent interstate or
c) make it an investment property and buy interstate?

I am having difficulties on finding any info on doing this, especially with regards to tax benefits. (one site said all we would pay on the investment property would be or so a week??)
