I have rented my house to my sister over 2 years ago. About 6 months ago she asked if she could pay her rent?
on the 15th for a couple of months. I said that was okay for a couple of months. That was over 6 months ago. When she moved in, I wanted the rent on the first so I wouldn’t be late on my house payment. She is still paying on the 15th. We have not spoke since x-mas eve and her Feb rent has not been paid. There is no lease. What should I do?

I have an underwater mortgage but would like to move up. Will I qualify?
I purchased a condo in 2006 that, of course, has greatly depreciated. Even though I put 20% down, half of the neighborhood foreclosed and the condo value depreciated from $120K to about $40-50K! I still am underwater by about $30-40k.
Since then, I met and married my wife and she moved in. We would like to move out of my “bachelor pad” and start a family. We want to keep the condo to avoid selling at the bottom of the market and taking a bath, while still qualifying for a new house. I could easily rent my condo to cover most or all of the costs. We are hoping to close this fall (October 2011)
As always with these types of questions there are a lot of parameters, so I’ll lay them out for you:
Our monthly gross income is $8,000 – this is solid w-2 income, not self employed or any other type of income.
Our monthly debt is as follows:
Mortgage: $618
Association fee: $124
Property taxes: $133 (and dropping)
Car payment 1: $583 – 0% loan will be paid off in March, 2012
Car payment 2: $421 – 0% loan will be paid off in May, 2014
Student loans: $20
Credit: the lowest of both of our credit scores from any of the 3 bureaus is 720.
Down payment: We will have $47,000 available for down payment and closing costs.
Loan amount: We are interested in homes valued around $250-260k, so the loan amount would be around $210-220k depending on closing costs.
Other assets: approx $40K in non-liquid or retirement assets.
Doing the math, our current debt-to-income back ratio is 24%. However, if you exclude car payment 1, which will have 5 payments left by the time i apply for this, its about 16.8%. I could even use some of my cash to just pay it off if a lender wanted to include it as debt.
I think this leaves a lot of wiggle room for us to qualify for a new mortgage, even if I have to pay PMI I would love to get out of here. Note that I did not include rental income in the equation because
I do not want to rely on having a tenant 100% of the time, I want to be able to afford both payments on my own.
Short selling,strategic default, etc. are last-resort options at this time. I feel they are unethical since I can pay the bills comfortably and I do not want to ruin my credit.
So all of my math seems to point to qualifying for a loan in my desired price range, without pushing the DTI above the limits.
I plan on speaking with an advisor on this but I wanted to know before i start this process if we are likely to qualify based on this information? Sometimes it seems that honest people who save and pay their bills on time are getting screwed in this world, and I just want to make sure I’m not off base with anything.
update: thanks for the response – the insurance is rolled into the association fee, which is why it is excluded. The larger car payment can be excluded because it will be paid off.

The mortgage on the condo is going to hurt you until you have at least a full year of stable rental income, preferably from a single tenant. At that point most lenders will look at it as a wash if your rents cover most of your outgoing cash on the rental unit.
A $200k note will run you about $972 P&I per month at 4.15% (assumes a 750+ FICO) so figure $1,300 a month for PITI. That pegs your DTI at close to 40%, well outside the affordability target of 34%. That’s partially offset by a housing cost ratio of around 17%.
Once you have a tenant in the condo for a year the condo costs will drop from the ratio (they won’t consider the income, just treat it as a wash) and with the higher car note being paid off your total DTI drops to below 22%.
While the numbers look to be a bit of a stretch right now, things are moving in the right direction. Although most lenders have tightened lending criteria the ones who are being shut out are those with no chance of being able to afford the payments. You’re not in that position if you keep moving in the direction that you are so you may be able to find a lender who will work with you.
I would like to see some rainy day savings too. If you use the $47k for down payment and closing costs, your emergency funds will be wiped out. That’s never good. I did a re-fi while I was unemployed back in 2009 largely because I had over a year’s worth of income in readily available liquid investments, so having (or not having) a significant emergency fund can impact the lending decision.

I’ve been friends with this girl ever since i was little she‘s always been a lesbian. She‘s 31 and I’m 23. She moved away for awhile but then she came back. By that time i had moved out of the neighborhood. I found her on facebook i called her and we talked on the phone she called me a few times too. On facebook i would posted a status saying “like or comment my status asking me who i was talking about. I finally told her it was all about her i also told her i thought she was cute. She said Really? and thank you. I texted her a lot once she told me she couldn’t do for herself and that she needed a pair of shorts she wanted me to buy them for her birthday i didn’t though. I went to visit her and i asked her if she wanted to be my friend she said yes and that i needed to stop texting her so much we were both happy to see each other we hugged each other twice. I cut back on texting her so much. We argued on facebook she then told me she was trying to get her life together and that she wasn’t interested in having a girlfriend.
I told her we weren’t friends and that it was all in my head and then she said “Wow i thought we were friends I’m a little hurt” After wards I told her that i never wanted to be her girlfriend and that i had a boyfriend that i have been with for awhile. She then said this “U r funnie…but i understand that ur feeling r hurt and i’m sorry for that…..u went out into the deep end telling me about ur boyfriend of 5yrs but u NEVER and u mean NEVER want’d to be my girlfriend, right…HA…u need to stop it. And i hope everything works out wit u and your boyfriend. Happiness is everything…good luck“.I made a few status comments about my boyfriend i said that i was making him a certain food that i know she likes and that’s when she blocked me. she told me she blocked me because I’m retart and the way i call and text her is like i want to be more then friends and that she feel like she always have to explain herself. I told her i was sorry for leading her on she yelled saying she never took what i said seriously. I asked her was she mad that i had a boyfriend she yelled and said no she didn’t care. This dude or my so called bff lead me on and act like nothin happened.
Long story short. I liked this dude, he moved….we started talkinh over facebook, we started flirting, and he was gettin ready to ask me out, and then a girl who goes to my school, got a facebook and started talkin to him (well he had a long crush on her for 3years and asked her out millions of time but she said no every time) well she gets on and starts talking to him, she apparently likes him now and flirts with him, and now he forgot all bout me and says were bffs still he said maybe we can go out in the distance future. I told him exactly how i feel about this and he like i really do like u honest, and i want to date u but u know how bad i want to be with this girl, i have been tryin to get with her for 3yrs. I just said wat eva and we still talk but when i bring up stuff like this he says he has to go or changes the subject or says idk…..What should i do bout this, the girl talks to me and know i really like him, and she says i dont want to date him but i dont want him to move on. It doesnt help that my heart still loves him, everyone even my friends say move on BUT theres no one to move on to, no guy ever liked me like he did, all the guys i no are shallow and wont get to know me bcuz of my apperance. There are heaps of other guys out there, who will like you the way he did. Search for someone else, and know that there are heaps of guys to choose from. My advice on moving on is to stop talking to him all together, and make yourself really busy. Know that he’s not worth thinking about all the time.

NY–Can a landlord keep your security if you decide not to move in to an apartment?
my mom was supposed to rent this apartment but the landlord/manager is being a real pain in the you know what about giving her the keys and stuff so she can move stuff in, she has paid the security but with the attitude of this guy she is not sure she want to move in there anymore, so can he legally keep her security deposit?

If your mother signed a lease and gave deposits stating she is going to take possession of the place on a certain day and the landlord is being a total tard and not giving her the keys to move in then NO he voided the Contract.
